Associé du cabinet, Adam Kardash axe sa pratique presque exclusivement sur le régime juridique de la protection des renseignements personnels et sur la gestion de l’information. Il est le chef de notre groupe national sur la protection des renseignements personnels et de la gestion de l’information. Adam est aussi membre du comité exécutif du cabinet et membre du groupe de pratique du marketing et de la publicité.

Adam est également directeur général et chef d’AccessPrivacy, un service-conseil complet et innovateur complémentaire à la pratique nationale de Heenan Blaikie en matière de protection des renseignements personnels qui a été lancé en 2009 et qui vise le respect des renseignements personnels. AccessPrivacy offre un forum sur le Bureau du directeur de l’information et de la protection de la vie privée ainsi que Private Sector Source, un outil novateur fournissant aux dirigeants, avocats et professionnels de la conformité un accès pratique et économique aux ressources requises pour la gestion des questions de conformité au Canada. En 2013, Adam a reçu le prix Karen Spector en reconnaissance de l’excellence en droit de la protection de la vie privée.

Adam est conseillé spéciale auprès de l’Interactive Advertising Bureau of Canada. Il jouit d’une vaste expérience de la protection des renseignements personnels et est régulièrement consulté quant à des questions de protection des données informatiques et des initiatives de protection de la confidentialité. En matière de protection de renseignements personnels, il collabore avec des conseillers juridiques en entreprise et des cadres supérieurs chargés des mesures de protection de diverses institutions du secteur privé, de la santé ou à but non lucratif. Il les aide à effectuer des études d’impact sur la vie privée et des enquêtes sur les mesures de protection des renseignements personnels et de la confidentialité, à formuler des politiques, des pratiques et des procédures, à s’engager à entreprendre des initiatives de conformité aux obligations de protection des renseignements personnels et à gérer les atteintes à la sécurité. Il les représente dans des enquêtes sur la conformité à la réglementation pertinente et les assiste également dans la rédaction de politiques et la conception de procédures de conformité, de même que dans la négociation et la rédaction d’ententes de service mettant en jeu le partage de renseignements personnels, y compris le flux transfrontalier de données.

Il a également collaboré à un large éventail d’opérations commerciales ayant trait aux technologies de l’information, y compris l’acquisition de technologies, les cessions de licences et les ententes d’impartition et de services, en plus de s’être penché sur des questions d’ordre général en droit des sociétés et en droit commercial pour des entreprises faisant des affaires sur Internet ou dans un environnement électronique.

En avril 2007, en collaboration avec Priscilla Platt, également du cabinet, il créait et lançait le guide électronique de Heenan Blaikie consacré au régime du secteur public ontarien relatif à l'accès à l'information et la protection des renseignements personnels. Le guide, AccessPrivacy.ca, est un outil innovateur conçu pour aider les institutions et le public à comprendre les développements juridiques dans ces domaines. Les questions juridiques d'accès à l'information à l’échelle fédérale ont par ailleurs été récemment intégrées à la mise à jour de ce guide électronique.

Adam est président de la Section de protection de la vie privée de l’Association du Barreau de l’Ontario, membre de la Section du droit de la vie privée de l’Association du Barreau canadien et il a siégé pendant trois ans à la direction de la Section de commerce électronique et de technologie de l’information de cette association. Il donne régulièrement des communications sur la technologie de l’information et la protection des renseignements personnels; pendant trois ans, il a donné un cours sur les enjeux juridiques du commerce électronique dans le cadre du programme de MBA de la Schulich School of Business de l’Université York.

 Il est reconnu comme un des meilleurs praticiens en matière de publicité et marketing aux fins de l’édition 2013 du répertoire The Best Lawyers in Canada (Woodward/White).
